The Internal Security Act 1960 (ISA) is a preventive confinement law in power in Malaysia. The enactment was enacted after Malaysia progressed freedom from Britain in 1957. The ISA takes into consideration detainment without trial or criminal accusations under limited, lawfully characterized situations. On 15 September 2011, the Prime Minister of Malaysia, Najib Razak stated that this enactment will be revoked and displaced by two new laws.

The Act however is not yet in power starting July 2012 as it is awaiting the advertisement of the Minister of Home Affairs. Preventive detainment was first executed in Malaya by the British in 1948 to battle the furnished insurrection of the Malayan Communist Party throughout the Malayan Emergency.

The Emergency Regulations Ordinance 1948 was enacted by the British High Commissioner Sir Edward Gent. It permitted the confinement of persons for a period not surpassing one year. This mandate focused at acts of roughness and just encroached provisional detainment. The Malayan Emergency finished in 1960 and the mandate was revoked. Then again, preventive detainment was held and remains a characteristic of Malaysian law today. In 1960, the legislature passed the Internal Security Act (ISA) under the authority allowed by Article 149 the Malaysian Constitution. The stated motivation behind the ISA was to discourage socialist activity in Malaysia throughout the Malayan Emergency and a short time later.

The principal Prime Minister of Malaysia, Tunku Abdul Rahman, outlined the motivation behind the act as to \"be utilized singularly against the communists.My Cabinet associates and I gave a serious guarantee to Parliament and the country that the massive powers given to the legislature under the ISA might never be utilized to smother legitimate opposition and hush legal contradiction\".
